What is the EB-5 Program

A federal pathway to U.S. permanent residency, administered by USCIS.

The EB-5 Immigrant Investor Program was created by Congress in 1990. Under this program, qualified foreign nationals may apply for U.S. permanent residency by participating in projects that create U.S. jobs. Through a USCIS-approved Regional Center like Open EB5, the application process is structured and well-documented, but every immigration outcome is determined exclusively by USCIS based on its own criteria.

  • $800,000 minimum (TEA) Targeted Employment Areas qualify for the reduced threshold instead of the standard $1.05M.
  • Permanent residency for the family Green Card for the applicant, spouse, and unmarried children under 21.
  • 10 U.S. jobs created per applicant Direct and indirect jobs through Regional Center projects, eligibility tracked by USCIS.
  • Reserved visa categories (Rural / High-Unemployment) Faster I-526E processing for set-aside categories under the EB-5 Reform Act of 2022.

Frequently Asked Questions

Answers, not generalities.

What is the minimum investment for EB-5 in 2026?
$800,000 for projects located in Targeted Employment Areas (Rural or High-Unemployment). Standard projects require $1,050,000. All Open EB5 projects qualify for the $800K threshold.
How long does the EB-5 process take?
I-526E adjudication ranges from 12–24 months depending on category. Reserved set-asides (Rural, High-Unemployment, Infrastructure) typically see faster processing. Conditional Green Card follows approval; the I-829 is filed two years later for permanent status.
Is the investment refundable?
EB-5 investments are at-risk by statute, there is no guaranteed return. Open EB5 projects are structured with capital-preservation strategies and full transparency. Our counsel reviews each subscription agreement individually with the applicant.
Do I need a lawyer separate from Open EB5?
Yes, every EB-5 applicant must retain independent U.S. immigration counsel to file I-526E. Open EB5 works with several established firms and can refer you, but the attorney-client relationship is yours, not ours.
What languages does Open EB5 support?
English and Spanish natively. We coordinate translators for Portuguese, Mandarin, and Vietnamese on a case-by-case basis. All legal documentation is provided in English with certified translations as needed.
Where are Open EB5 projects located?
Currently all active and pipeline projects are in Texas (Brownsville and the Rio Grande Valley), Rural and High-Unemployment TEAs that qualify for reserved visa set-asides under the EB-5 Reform and Integrity Act of 2022.
